1. Agreement and Business Information

These Terms of Service ("Terms") are effective October 21, 2026. They govern your use of our website at https://firesafechimneycleaning.com (the "Site"), the chimney cleaning and related services we provide (the "Services"), and our text messaging program. By using the Site, requesting Services, or opting in to receive text messages, you agree to these Terms. If you do not agree, please do not use the Site or the Services.

"Fire Safe Chimney Cleaning," "we," "us," and "our" mean Jerry Abbott, a sole proprietor doing business as Fire Safe Chimney Cleaning, as registered with the Idaho Secretary of State.

2. Services, Scheduling and Payment

We provide chimney cleaning, inspection and related services to residential and commercial customers in Idaho. The scope of each job is the work described in the estimate, quote, work order or invoice we give you.

Estimates and scheduling. Estimates are based on the information you give us and what we can see at the time. If we find conditions that change the work (for example, damage, blockage or heavy creosote buildup), we will tell you and explain any change in price before we continue.

Appointments. We will confirm appointment dates and arrival windows by phone, email or text. Please give us at least 24 hours' notice if you need to cancel or reschedule so we can offer the time to another customer.

Payment. Payment is due when the work is completed unless we agree otherwise in writing. We accept the payment methods listed on your invoice. Unpaid balances may be subject to collection, and you are responsible for reasonable costs of collecting an overdue balance to the extent allowed by Idaho law.

Records of work. We may take notes and photos of your chimney, appliance and the surrounding area to perform the work and document what was done and found. See our Privacy Policy for how we handle this information.

3. Text Messaging (SMS) Terms

These terms apply to the Fire Safe Chimney Cleaning text messaging program, operated by Jerry Abbott, DBA Fire Safe Chimney Cleaning. By opting in, you agree to them.

Program description

We send text messages to customers and prospective customers who have opted in. There are two separate types of messages, and you choose each one on its own:

Transactional and informational messages. Appointment confirmations and reminders, service follow-ups, estimate and invoice information, scheduling and arrival updates, and replies to texts you send us.

Promotional messages. Special offers, discounts and seasonal reminders from Fire Safe Chimney Cleaning.

How to opt in

You opt in by checking the box for the type of message you want on the text messaging widget on the home page of https://firesafechimneycleaning.com and submitting your phone number. There are two separate, unchecked boxes, one for each message type. You may select either one, both, or neither. Checking a box is not required to use the Site or to buy our Services, and consent to receive text messages is not a condition of any purchase. By checking a box and submitting the widget, you give your express consent to receive recurring automated text messages of that type from us at the mobile number you provided. Our text messaging program is available only to people who are at least 18 years old. By submitting the widget, you certify that you are at least 18 years old, that you are the subscriber or authorized user of the mobile number you entered, and that you have the authority to consent to receive text messages at that number.

Message frequency

Transactional and informational: message frequency varies depending on your appointments and requests.

Promotional: up to 3 messages per month.

Costs

Message and data rates may apply. Your mobile carrier may charge you for text messages according to your plan. We do not charge for text messages.

How to opt out and get help

Reply STOP to any message to stop receiving texts from us. You will receive one confirmation message, and then no further messages unless you opt in again. You may also opt out by calling 208-291-0301 or emailing [email protected]. If you only want to stop promotional messages, tell us and we will continue only the transactional messages you chose.

To start receiving messages again after opting out, reply START or submit the widget on our home page again.

Other important terms

Supported carriers include major U.S. wireless carriers. Carriers and their affiliates are not liable for delayed or undelivered messages, and delivery is not guaranteed.

Message content may be changed or discontinued at any time, and we may end the text messaging program with or without notice.

You agree to tell us if your mobile number changes or is reassigned so that we do not text someone else by mistake.

We keep a record of your consent, including the date, time and the wording you agreed to.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. 4. Customer Responsibilities, Disclaimers and Liability

Your responsibilities

Give us safe, clear access to the chimney, appliance and work area, and let us know about known hazards, prior damage or previous repairs.

Make sure that a fireplace, stove or other appliance is cool and has not been used for at least 24 hours before our arrival, unless we tell you otherwise.

Tell us if you are not the owner of the property, and make sure the owner has approved the work.

Protect or move valuables near the work area. We take reasonable care to protect floors and furnishings, but chimney cleaning is a dusty and sooty job.

Inspection findings and safety

Our inspections and cleanings are based on what we can reasonably see and reach during the visit. We cannot detect every defect, and a cleaning or inspection is not a guarantee that a chimney or appliance is free from all hazards or that a fire will never occur. We may recommend repairs, relining or other work by a qualified professional. It is your responsibility to decide whether to follow our recommendations. Please follow the manufacturer's instructions and local codes when you use any appliance.

Disclaimer of warranties

The Site is provided "as is" and "as available." To the fullest extent allowed by Idaho law, we make no warranties of any kind about the Site, and we disclaim all implied warranties. We perform the Services with reasonable skill and care.

Limitation of liability

To the fullest extent allowed by Idaho law, Fire Safe Chimney Cleaning and Jerry Abbott are not liable for indirect, incidental, special or consequential damages arising from the Site or the Services. Our total liability for any claim related to the Services is limited to the amount you paid us for the specific service that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

If you believe our work was not done properly, please contact us within 7 days so we can look into it and, where appropriate, make it right.

5. Website Use, Governing Law, Changes and Contact

Use of the Site

You agree to use the Site only for lawful purposes and not to interfere with its operation, submit false information, or enter a phone number that is not yours. The content on the Site, including text, logos and images, belongs to Fire Safe Chimney Cleaning or its licensors, and you may not copy or reuse it without our permission. The Site may link to third-party websites, and we are not responsible for their content or practices.

Governing law

These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Services will be brought in the state courts located in Boise County, Idaho, and you consent to that venue.

Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on the Site with a new effective date, and your continued use of the Site or the Services after that date means you accept the changes. If we change the text messaging terms in a material way, we will ask for your consent again where the law requires it.
